Ratings must remain suspended till BARC takes action to address concerns: NBA

New Delhi, January 18

In the wake of purported WhatsApp conversations between Republic TV editor-in-chief Arnab Goswami and former Broadcast Audience Research Council (BARC) head Partho Dasgupta emerging in the public domain, the News Broadcasters Association (NBA) on Monday said ratings of television news channels should remain suspended till the TV ratings agency takes action to address concerns and shares details of it with the stakeholders.

In a statement, the Rajat Sharma-headed NBA said it is “shocked to see hundreds of WhatsApp messages that have been exchanged between BARC India’s former CEO—Partho Dasgupta—and Arnab Goswami, Managing Director, ARG Outlier Media Pvt. Ltd”.

It demanded that the Indian Broadcasting Foundation (IBF) membership of Republic TV should be suspended with immediate effect till the case related to manipulation of ratings is pending in court.

According to the statement, the NBA urged the BARC to come up with a clear statement about the veracity of its ratings in the period during the audit and also conduct an audit of the Hindi news segment.

“Expunge the data of the erring broadcaster and restate the real position of rankings of all news channels from the beginning,” it demanded from the ratings agency.

The BARC should explain the concrete steps taken by it in the last three months to secure the ratings and bring transparency to the process as well as create a system, whereby any change to the ratings that impacts the news ecosystem is done only after due consultation with a BARC sub-committee of NBA nominees, it said.

The NBA also asked the BARC to explain what penal actions are provided for in its constitution against broadcasters who have indulged in manipulation of ratings of this magnitude and what action will be taken in the current case.

The ratings of news channels must remain suspended till the time all details of such actions taken by the BARC are shared with the stakeholders, it said.

The NBA’s board also wants to place on record that the “corrupt data released month after month” has not only led to reputation loss, but has also caused huge financial losses to news broadcasters, for which the BARC is duty-bound to give an explanation, the statement said.

Dasgupta, who was arrested in the fake Television Rating Point (TRP) case, is now in the ICU of the state-run JJ hospital in central Mumbai.

A diabetic, he was rushed to the hospital from the Taloja Central Prison in Navi Mumbai on Saturday after his blood sugar levels went up on Friday midnight.

As the controversy surrounding the alleged TRP scam grew, the BARC, which provides TRP data, announced a temporary suspension of the weekly ratings of news channels across languages in October last year.

The NBA is the largest organisation of news broadcasters, consisting of almost all major news networks of the country. Republic TV, however, is not a member of the NBA. PTI

No coercive action against Arnab Goswami till Jan 29 in TRP case: Mumbai Police

Mumbai, January 15

The Mumbai Police told the Bombay High Court on Friday that it will not take any coercive action till January 29 against Republic TV editor-in-chief Arnab Goswami and other employees of ARG Outlier Media Pvt Ltd in the alleged fake TRP scam case.

ARG is the parent company that runs all Republic TV channels.

A division bench of Justices S S Shinde and Manish Pitale also extended till January 29, the interim relief for employees of the complainant company in the case, Hansa Research Group, by directing the police to ensure they are called for inquiry for not more than two days a week.

The bench also took on record the status report filed by the Mumbai Police in its investigation in the alleged scam which came to light late last year.

ARG media had approached the HC last year seeking, among other things, that the police be restrained from taking coercive action against its employees.

On Friday, ARG’s counsel senior advocate Harish Salve told the court that the allegations of the Mumbai Police that Goswami paid bribes to rig TRP numbers was “nonsensical.”      

Salve said the Enforcement Directorate (ED) had registered a money-laundering case related to the alleged TRP scam and was probing the same.

He said the HC must call for a status report from the ED, too, and if the contents of the status reports filed by the Mumbai police and the central agency differed much, the court would realise the case against ARG was malafide.

The ED’s counsel, Additional Solicitor General Anil Singh, told the bench that the central agency had readied its status report and the court must accept it in a sealed cover.

The Mumbai Police’s counsel, senior advocate Kapil Sibal, however, opposed the ED’s submissions.

Sibal raised questions on the ED’s locus standi in the matter. He also reminded the court that the financial probe agency was not a party in the case before the HC.

Salve, however, told the HC that ARG had amended its plea and sought that the ED be impleaded as a party.

The court then directed Sibal to file his reply to the amended plea and the ED being impleaded, by the next date of hearing.

While opposing the ED being joined as a party, Sibal went on to question the central agency’s “enthusiasm” to file its status report even before it was impleaded as a party.

“I have strong objections to the ED appearing in this matter. Why is this enthusiasm..,” Sibal said.

Salve, however, argued that the police must not have any opposition to the court going through the ED’s report.

“I dont understand how the State agency is trying to stop a Union agency from filing a report,” Salve said.

The court, though, refused to take the ED’s status report on record on Friday and said it will consider the same on the next date of hearing.

On January 6, Sibal had told HC that the Mumbai police will not take any coercive action against Goswami and employees of ARG till January 15.

On Friday, as the HC granted the police time to file its reply to the amended petition and adjourned the hearing to January 29, Sibal submitted that he had no objection to such protection being extended till then.

The HC accepted Sibal’s submission.

ARG Media has filed several pleas and interim applications in the HC urging the court to transfer the probe in the case to the Central Bureau of Investigation (CBI) or any other independent agency.

The pleas also urge the court to stay in the meanwhile, any further investigation in the case, and to restrain the police from taking any coercive action against the petitioners, their employees, or investors.

The alleged racket was uncovered in October last year when the Broadcast Audience Research Council (BARC) filed a complaint claiming certain television channels were rigging TRP numbers. PTI

Salesforce says it has taken action against the RNC, but won’t say how

Salesforce has “taken action” to stop the Republication National Committee (RNC) from sending emails that could incite violence, though the company won’t say what that action is. The RNC is using ExactTarget, a Salesforce tool, for campaign emails.

The move, first reported by Motherboard, comes after the Trump campaign sent an email urging supporters to “step up RIGHT NOW” and “defend the integrity of this Election” shortly before the breach of the US Capitol on January 6th.

Salesforce confirmed to The Verge that it hasn’t dropped the RNC as a client. “The Republican National Committee has been a long-standing customer, predating the current Administration,” a spokesperson said. “We have taken action to prevent its use of our services in any way that could lead to violence.”

The enterprise software company declined to elaborate on what action it has taken and whether the mysterious measure would affect the Trump campaign, as well as the RNC.

Before the attack, the Trump campaign sent emails saying the election was rigged and the results needed to be overturned. The campaign sent 569 emails between November 3rd and January 6th, including four emails the morning of the breach, Motherboard reports.

Each email asked supporters to donate money to the campaign. While it’s not known how big the ExactTarget email list was, in 2018, the Trump campaign reportedly had contact information for 20 million supporters.

The RNC told Motherboard that it had ‘independently’ decided to stop its digital fundraising efforts on January 6th. The following day, another email service — Campaign Monitor — suspended the Trump campaign’s account. That alone would make it harder for the campaign to raise money.

Social media platforms are also taking action against Trump in the wake of the attacks in DC. On January 7th, Facebook blocked the president indefinitely, and at least until Joe Biden’s inauguration. The following day, Twitter permanently banned Trump’s account.

The news from Salesforce isn’t quite so decisive. Perhaps, like Campaign Monitor, the company is making it more difficult for Trump to fundraise. We can’t know for sure, because Salesforce won’t answer our questions.

Bianca Andreescu back in action in Melbourne

Canadian tennis player Bianca Andreescu is expected to return to competition in late January in Melbourne as part of a pre-tournament for the Australian Open.

A superb class action case against Ottawa

To better swallow the pill to the thousands of Gaston M. who were trapped by the modification of the eligibility criteria for self-employed workers for the PCU, the Canada Revenue Agency is going there gently to recover the PCU supposedly paid by fault.

“We understand that you may have made an honest mistake in requesting the ECP and want to reassure you that no penalties or interest will be applied to your ECPs payments. However, we encourage you to repay the PCU amounts before December 31, 2020 so that we do not send you a tax slip for the amount you received, ”says the Collections and Verification Branch of Revenue Canada in the letter sent to Gaston M.


“In my case,” he says, “it’s not the penalties that bother me, but rather the very substance of the matter, which is really very simple: can the CRA (Canada Revenue Agency) change the rules? rules of the game, once the game has been fully played and finished? “

In my opinion, it is fiscally unfair to change the eligibility criterion on the income of self-employed workers along the way.

Farmers’ agitation: Will decide next course of action in 2-3 days, say protesting unions

New Delhi, December 19

 Farmer unions protesting against the three agriculture laws on Saturday said they will decide their next course of action in the next two-three days, after the Supreme Court earlier this week pointed out it was thinking of setting up an “impartial and independent” panel of agriculture experts and peasants’ unions to resolve the deadlock.

Farmer leader Shiv Kumar Kakka said discussions among unions are currently underway to decide their strategy, adding that they are also seeking legal opinion on the matter.

“Our meetings are being held for the next course of action. We hope that in the next two-three days, we will have clarity on whether we should be part of a committee as suggested by the court,” Kakka told PTI.

Another leader Balbir Singh said farmers will not call off their protests until their demands are met.

“We are ready for a long haul. We are here for our rights. We are in the process to decide our stand following the court’s order,” he also said.

Thousands of farmers have been staying put at several Delhi border points for the last 23 days, demanding a repeal of the new agri laws.

Meanwhile, All India Kisan Sabha (AIKS) Saturday claimed that 33 farmers participating in the ongoing protests have so far died since November 26 due to accidents, illness and cold weather conditions.

According to AIKS, ‘Homage Day’ will be observed in different parts of the country on Sunday to pay tributes to those farmers who lost their lives.

Earlier this week, the Supreme Court had acknowledged the right of farmers to non-violent protests and mooted the idea of putting on hold the contentious farm laws to enable negotiations with the agitating farmers, which was opposed by the Centre, which said the agriculturists would not come forward for the talks then.

The apex court, which made it clear that the issue of farmers’ protest and the right of others to move freely would be dealt on priority at the moment and not the validity of the laws, also said it was thinking of setting up an “impartial and independent” panel of agriculture experts and farmer unions to resolve the impasse.

The top court said it was of the view that the farmers’ right to protest should not infringe the fundamental right of others to move freely and in getting essential food and other supplies as right to protest cannot mean blocking the entire city.

The apex court, which said it was worried with the way things are going on, was told by both the Centre and one of the farmers’ unions that the negotiations are not happening at the moment.
