Expressing doubt on the woman’s charge, the court acquitted the petitioner with a bail amount of Rs 1 lakh and some conditions. The judge was not satisfied with the complainant’s explanation that she had fallen asleep after the rape. While giving his verdict, the judge said that it is unsuitable and the women here do not behave like this after being raped.

Along with the bail order, the judge said that the complainant woman failed to explain what she had gone to her office at 11 pm on the day of the alleged incident and why she had not objected to drinking alcohol with the accused.

The court granted bail to the rape accused on six conditions and according to the order, if any condition is violated, his bail will be canceled. Apart from this, the accused will have to report to the police station on every second and fourth Saturday of the month.

At the same time, the complainant’s lawyer opposed this bail and said that the crimes against the accused are serious and sufficient evidence has been presented to prove it. Describing the anticipatory bail of the criminal as ‘unsafe for the society’, he demanded the dismissal of his plea.

To this, the judge said that the ‘serious nature’ of the crime cannot be grounds for depriving the citizen of freedom, especially when no ‘prima facie’ case has been made by the police.

The judge said, “The complainant says that he was raped by making a false promise of marriage, but it is a little difficult to believe the case given the circumstances.”

The judge also questioned the complainant woman on why she did not come to the court when the accused was forcing her to have sexual favors.
