MP Assembly Speaker turned down Supreme court’s proposal
Bhopal / New Delhi. A bench of Justice DY Chandrachud and Justice Hemant Gupta said that he can make arrangements to ensure that the rebel MLAs have gone on their own. The bench said, “We can also appoint a supervisor in Bengaluru or elsewhere, so that rebel MLAs can contact the Speaker through video conference and then take that decision.” The court also asked the Speaker whether any inquiry was done in connection with the resignation of rebel MLAs and what decision they have taken in respect of their rebel MLAs.
On behalf of the chairman, senior advocate Abhishek Manu Singhvi said that the day the court starts giving instructions to the president under the deadline, it will become a constitutional problem. Counsel appearing for Governor Lalji Tandon told the court that Chief Minister Kamal Nath is sitting comfortably and the Speaker is fighting a legal battle in the court. The bench asked all the parties whether the Speaker’s decision in the matter of resignation and disqualification of MLAs is a power test. He said that according to the constitutional principle the power of resignation and disqualification cases pending before the Speaker No Rake on individual tests.
