Pence asks to reject demand to modify election result | The State

The Justice Department, on behalf of Mike Pence, asked a federal judge to dismiss the lawsuit filed by a Republican congressman to modify the general election result won by Democrat Joe Biden.
Lawmaker Louie Gohmert and 11 of his Republican colleagues they asked federal judge Jeremy Kernodle to declare that Pence has “the sole authority and discretion” to decide which electoral votes from certain states should be counted to proclaim a candidate’s victory.
According to the Justice Department, the congressmen “have sued the wrong defendant (Pence)” in case they have “a legally recognizable claim.” The complaint is understood against procedures established in the law and not against “the actions Vice President Pence has taken“.
In conclusion, the DOJ sees a contradiction in the legal action brought by Gohmert.
Pence, who by the constitution also serves as president of the Senate, will preside over the session that will declare Biden the winner of the elections next Wednesday. Normally, the role of the vice president in that ceremony is purely symbolic, as stipulated in the 1887 standard.
Donald Trump has yet to admit defeat in the November 3 election and has continued to cling to unsubstantiated allegations of alleged mass electoral fraud.
The still president and his allies filed dozens of lawsuits in court during the weeks after the elections, all rejected by progressive and conservative judges, including those of the Supreme Court.
