In the charge sheet filed against the suspended Aam Aadmi Party (AAP) councilor Tahir Hussain, the main accused of communal violence in the north eastern district of the capital Delhi, two employees working here have made him a witness. Both these employees have told what Tahir Hussain was doing before the riots and what they saw there that day. According to the chargesheet, both the employees of Tahir Hussain saw him talking to several persons in a ‘very secretive’ manner.
In their statement to the police, Girish Pal and Rahul Kasana said that on February 24, they were present in Hussain’s office in Khajuri Khas area. The charge sheet stated that in the afternoon he had seen several people gathering at the basement of Tahir Hussain’s house and that he was talking with them in a very confidential manner. He said that the accused Shah Alam, Irshad, Abid, Arshad Pradhan, Rashid and Shadab were also present along with the other accused, including Tahir Hussain.
The chargesheet has stated that the chief witness left the place after hearing the noise of the crowd outside and feeling the tension in the office. The crime branch of Delhi Police filed a charge sheet last month against Tahir Hussain and 14 others before Chief Metropolitan Magistrate Pawan Singh Rajawat. The court will hear the chargesheet filed by Delhi Police in August.

According to the chargesheet, the copy of which has been given to prosecution witness Rajbir Singh Yadav, who was overseeing wedding meal preparations at a parking lot near Hussain’s house. He has said in a statement to the Delhi Police that the food prepared for the friend’s sister’s wedding was wasted by the mob. Not only this, accused Riyakat Ali looted Rs 62,000 from him.
The accused Shah Alam Ali was also present along with many others and Hussain was also involved in the mob. Another prosecution witness said that Hussain was present on the roof of his house and was throwing stones and giving directions to others present with him, who were also throwing stones and petrol bombs towards the parking lot.
The charge sheet states that during the investigation, an attempt was made to collect CCTV footage of the incident from private and government cameras, but no video was found as there was no CCTV nearby.
Hussain charged with 14 others under various sections of the Indian Penal Code for rioting, unlawful assembly, criminal conspiracy, promoting enmity between different groups on the basis of religion and caste and charges under various sections of the Arms Act The letter has been filed.
Hussain has also been booked under the stringent anti-terrorism law – Unlawful Activities (Prevention) Act. A separate case related to the riots has been registered for allegedly being part of a ‘pre-determined conspiracy’ in the violence.
Communal clashes erupted in northeast Delhi on 24 February following violence between citizenship law supporters and protesters, killing at least 53 people and injuring around 200 people.
